Steps to Take After a Car Accident and How to Protect Your Rights

For January 2025, the National Safety Council forecasted the total traffic fatalities to be at 3,380. The council estimated 179 traffic fatalities may occur during the 2025 New Year’s Day holiday period. A car accident can suddenly result in victims suffering from life-altering injuries.  Whether it’s a minor collision or a major crash, the aftermath can be stressful and confusing. Car crash victims usually have to deal with injuries, vehicle damages, and insurance claims.

Knowing what to do after a car accident in Michigan or other states can help protect your rights and strengthen any future insurance or legal claims. Check the safety of everyone involved. If you or anyone else is injured, immediately call 911 for medical assistance.

This article will walk you through the steps you need to take to properly handle a car accident.

Ensure Safety and Seek Medical Attention

After verifying the safety of everyone and informing emergency services, try to relocate yourself and, if possible, your vehicle to a safer spot. Moving to a secure location can help reduce the risk of further accidents.

Check others for any visible signs of stress or trauma. Maintaining focus and avoiding escalating tensions is important.

Get yourself checked out by a doctor, even if you believe you have minor injuries. Some injuries have underlying symptoms that can only be detected by medical professionals.

Call the Police and Document the Scene

Your report to the police will result in authorities producing an incident report and taking a formal statement, which can be used later on if you decide to take legal action.

Examine the accident scene, record the time and weather, and document any other relevant information. Use your phone to photograph road damage from different angles. The evidence you have collected will support your case.

Be honest when providing details to the police. The police’s investigation will help clarify the facts of your case, resulting in the protection of your rights.

Exchange Information With Other Parties

Obtaining information from other involved parties will help support your case.

See to it that you collect names, telephone numbers, and addresses for all drivers and passengers. Remember the insurance information, with the company and policy number identified. Gather contact details for anyone who might have witnessed the accident. Witness testimonies can substantiate your claims, increasing the likelihood of acquiring a favorable result for your case.

Capture images of the accident scene, the injuries sustained, vehicle damage, and traffic signs present.

Avoid admitting fault for the accident or giving out any statements without consulting a legal professional. Any statements you make can be used against you and can influence the outcome of your case.

A meticulous collection of details and relevant information allows you to protect your rights and effectively pursue your claims.

Notify Your Insurance Company

Victims of car accidents must always inform their insurance company promptly to receive the benefits and compensation they are entitled to under their insurance policy. Provide the insurance company with accurate information to avoid potential disputes or delays.

See to it that you are responsive and immediately comply with any additional information requests from the insurance company.

Keep a record of your conversations, including the insurance representative’s name and any claim or reference numbers provided.

Follow the instructions of the insurance company on how to process your claims. Be transparent and stick to the facts when providing information.

Hiring a lawyer after a car accident is necessary, especially if multiple parties are involved and injured. A lawyer can address the challenges of determining liability.

A skilled attorney can explain a client’s rights and help them handle the legal procedure. Lawyers can help their clients gather all relevant information, such as medical costs, lost wages, and pain and suffering, and provide fair compensation. They can also talk to witnesses and negotiate with insurance companies on your behalf.

Do not delay seeking legal assistance. In car accident cases, failure to comply with statutes of limitations can invalidate the case.

Investing in a lawyer specializing in car accidents allows you to focus on recovery while they handle all the legal aspects of your case.
